10-Week Growth & Value Build Terms
THE MEDIA REMEDY
10-Week Growth & Value Build
Terms of Service
Last Updated: October 7, 2026
These Terms of Service (“Terms”) govern participation in the 10-Week Growth & Value Build (“Engagement”) provided by The Media Remedy Enterprises LLC, doing business as The Media Remedy (“The Media Remedy,” “we,” “us,” or “our”).
The individual or business purchasing the Engagement is referred to as the “Client” or “you.”
By affirmatively accepting these Terms and submitting payment for the Engagement, you acknowledge that you have read, understood, and agreed to these Terms and that you have authority to enter into this agreement on behalf of the purchasing business.
1. The Engagement
The 10-Week Growth & Value Build is a hands-on business growth and implementation engagement designed to help Client build a stronger, more profitable, more owner-independent and increasingly transferable business.
The Engagement may address opportunities across areas including:
- Customer or client acquisition
- Offer, positioning and messaging
- Advertising and marketing systems
- Lead qualification and conversion
- Revenue recovery and follow-up
- Sales processes
- CRM, automation and technology
- Operational systems and workflows
- Delegation and owner independence
- Recurring and predictable revenue
- Business economics and profitability
- Business-value drivers and benchmarking
- Documentation and process development
- Other growth or operational priorities identified during the Engagement
The Engagement is customized to Client’s business. The items above describe areas that may be addressed and do not mean that every item will be implemented in every Engagement.
The Media Remedy will prioritize the initiatives reasonably determined to offer the greatest impact during the 10-week period based on Client’s circumstances, objectives, available resources and information.
2. Implementation
This Engagement is intended to be implementation-focused.
The Media Remedy may provide strategy, recommendations, planning, implementation, configuration, creation, optimization, coordination and other hands-on services as appropriate to the priorities established for Client.
Following onboarding, The Media Remedy will establish and begin executing the initial implementation priorities for the Engagement. Priorities may be adjusted during the 10 weeks as information, performance data or business circumstances change.
Client understands that business transformation is iterative and that reasonable adjustments to strategy, sequencing, systems or implementation may occur throughout the Engagement.
3. Engagement Period
The Engagement covers approximately 10 consecutive weeks of active implementation.
The Engagement period will ordinarily begin with Client’s scheduled onboarding/kickoff session or another implementation start date confirmed by The Media Remedy in writing.
Client agrees to schedule onboarding promptly and provide requested access, information and materials in a timely manner.
Delays caused by Client, including failure to provide necessary access, approvals, information, content or feedback, may affect timelines and deliverables and do not automatically extend the Engagement or create a right to a refund.
The Media Remedy may reasonably adjust the implementation schedule when delays are caused by third-party platforms, technical issues, advertising-platform reviews, regulatory requirements or other circumstances outside The Media Remedy’s reasonable control.
4. Investment and Payment
The investment for the 10-Week Growth & Value Build is:
$15,000 USD, paid in full.
Unless otherwise agreed in writing, this fee covers The Media Remedy’s professional services for the Engagement.
Advertising spend, software subscriptions, third-party platforms, media purchases, outside professional services, transaction fees, production expenses or other third-party costs are not included unless expressly stated otherwise in writing.
The Media Remedy will not incur material third-party expenses on Client’s behalf without Client’s authorization.
5. Cancellation and Refunds
Because The Media Remedy reserves capacity, allocates team resources and begins planning and implementation upon enrollment, payments for the Engagement are non-refundable once work has commenced, except where otherwise required by applicable law or expressly agreed by The Media Remedy in writing.
Client’s decision to discontinue participation, delay implementation or cease providing required access or cooperation does not create an automatic right to a refund.
If The Media Remedy elects to terminate the Engagement without cause before completing a material portion of the services, The Media Remedy may provide an appropriate refund or credit for services not performed, as reasonably determined based on work completed and resources committed.
Nothing in these Terms limits rights that cannot legally be waived.
6. Client Responsibilities
Successful implementation requires Client participation.
Client agrees to:
- Provide accurate and reasonably complete business information;
- Provide timely access to necessary accounts, systems, platforms and assets;
- Respond to reasonable requests for approvals, feedback and decisions;
- Designate appropriate decision-makers when necessary;
- Maintain required licenses, permissions and legal authority to operate its business and market its products or services;
- Review and approve material business claims, offers, pricing and representations before publication when reasonably requested; and
- Notify The Media Remedy promptly of material changes that may affect implementation.
The Media Remedy is not responsible for delays or performance issues caused by inaccurate information, lack of access, delayed approvals, Client inaction or other matters outside The Media Remedy’s reasonable control.
7. Advertising, Platforms and Third Parties
Certain implementation may depend on third-party services such as Meta, Google, Stripe, CRM providers, email or SMS providers, scheduling platforms, artificial-intelligence tools, website providers and other software or vendors.
The Media Remedy does not control these third parties and cannot guarantee their availability, approval decisions, policies, algorithms, account status or performance.
Client remains responsible for fees charged directly by third-party providers unless otherwise agreed in writing.
The Media Remedy is not responsible for platform suspensions, policy changes, outages, algorithm changes or other third-party actions outside its reasonable control.
8. Compliance and Regulated Businesses
Client is responsible for the legality of its products, services, business practices, advertising claims and industry-specific requirements.
The Media Remedy does not provide legal, tax, accounting, medical or regulatory advice.
For healthcare or other regulated businesses, Client remains responsible for applicable professional, advertising, privacy and regulatory requirements.
Client should not provide protected health information (“PHI”) or other specially regulated personal information to The Media Remedy unless the parties have specifically agreed upon appropriate handling procedures and, where legally required, entered into a Business Associate Agreement or other applicable agreement.
The Media Remedy may recommend that Client obtain advice from qualified legal, accounting, compliance or other professional advisors where appropriate.
9. Business-Value Benchmarking and Valuation Analysis
Where applicable, the Engagement may include business-value benchmarking, valuation analysis or use of third-party valuation tools to help establish a baseline, identify value drivers or evaluate potential areas for improvement.
Any such information is intended for business planning and strategic purposes only unless expressly stated otherwise.
It is not a certified appraisal, fairness opinion, guarantee of market value, guarantee of a future sale price or representation that a buyer, lender, investor or other third party will assign the same value to Client’s business.
The Media Remedy does not guarantee that the Engagement will increase Client’s valuation, sale multiple or eventual transaction price.
10. No Guarantee of Results
The Media Remedy will provide the Engagement in good faith and use commercially reasonable efforts to implement the agreed priorities.
However, business results depend on numerous factors outside The Media Remedy’s control.
Accordingly, The Media Remedy does not guarantee any specific amount of revenue, profit, leads, appointments, customers, cost savings, enterprise value, valuation increase, sale price, exit multiple or other financial or business result.
Examples, projections, case studies, forecasts or potential outcomes discussed before or during the Engagement are illustrative and are not guarantees.
Client retains responsibility for its business decisions and results.
11. Intellectual Property
Client retains ownership of materials, trademarks, data, content and intellectual property that Client owned before the Engagement.
Upon full payment, Client may use custom deliverables created specifically for Client during the Engagement for Client’s internal business and commercial operations.
The Media Remedy retains ownership of its pre-existing and independently developed intellectual property, including its methodologies, frameworks, processes, templates, systems, know-how, software configurations, concepts and proprietary materials, including without limitation the Infinite Revenue System™ and Exit-First Growth Framework™.
To the extent The Media Remedy’s pre-existing intellectual property is incorporated into a Client deliverable, Client receives a non-exclusive, perpetual license to use that material as part of the deliverable for Client’s own business operations.
Client may not resell, sublicense, reproduce for third parties or commercially distribute The Media Remedy’s proprietary frameworks or materials as standalone products without written permission.
12. Confidentiality
Each party may receive confidential or proprietary information from the other during the Engagement.
Each party agrees to use reasonable care to protect confidential information and to use such information only as reasonably necessary to perform or participate in the Engagement.
Confidential information does not include information that is publicly available through no breach of these Terms, was lawfully known before disclosure, is independently developed without use of the other party’s confidential information, or is lawfully received from another source without confidentiality restrictions.
Nothing in these Terms requires Client to provide information that Client is legally prohibited from sharing.
13. Limitation of Liability
To the fullest extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits or lost business opportunities, arising from the Engagement.
To the fullest extent permitted by applicable law, The Media Remedy’s aggregate liability arising out of or relating to the Engagement will not exceed the amount actually paid by Client to The Media Remedy for the 10-Week Growth & Value Build giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited or excluded.
14. Independent Contractor Relationship
The Media Remedy is an independent contractor.
Nothing in these Terms creates an employment relationship, partnership, joint venture, fiduciary relationship or agency relationship between Client and The Media Remedy.
Unless specifically authorized in writing, neither party has authority to bind the other to obligations with third parties.
15. Ongoing Services Are Separate
The $15,000 payment covers the 10-Week Growth & Value Build only.
It does not automatically enroll Client in an ongoing monthly retainer, performance-based compensation arrangement or other continuing engagement.
Near or following completion of the 10-week Engagement, The Media Remedy and Client may determine that continued growth, optimization, management or implementation services would be beneficial.
Any ongoing engagement will be governed by a separate agreement and separately agreed pricing.
Client is under no obligation to continue beyond the 10-week Engagement unless Client affirmatively agrees to do so.
16. Communications and Electronic Transactions
Client consents to conducting this transaction electronically and to receiving communications relating to the Engagement electronically, including by email and through the platforms used to deliver the Engagement.
Client agrees that electronic acceptance of these Terms and submission of payment may constitute Client’s acceptance of this agreement.
Client should retain a copy of these Terms for its records.
17. Governing Law
These Terms and the Engagement will be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
The parties agree to first attempt in good faith to resolve any dispute through direct discussion before initiating formal legal proceedings.
Unless otherwise required by applicable law or agreed in writing, any legal proceeding arising from these Terms will be brought in a court of competent jurisdiction in the State of North Carolina.
18. Entire Agreement and Changes
These Terms, together with the applicable checkout/payment information and any written scope or implementation details expressly incorporated by reference, constitute the agreement between Client and The Media Remedy concerning the 10-Week Growth & Value Build.
They supersede prior discussions or representations concerning the specific terms of the Engagement.
Any material modification to the Engagement must be agreed to by the parties in writing, including through electronic communication.
If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
A party’s failure to enforce a provision on one occasion does not waive its right to enforce that provision later.
19. Acceptance
By checking the box indicating acceptance of these Terms and submitting payment for the 10-Week Growth & Value Build, Client acknowledges that Client:
- Has read and understands these Terms;
- Has authority to enter into this agreement individually or on behalf of the purchasing business;
- Agrees to conduct this transaction electronically;
